terms is legally binding.
Terms and Conditions
§ 1 Scope and provider
These terms and conditions apply to all contracts for the purchase of digital content
concluded via this website between Jaroslava Perény, Horstweg 39, 14059 Berlin (the
“provider”) and you as the customer. Any deviating terms of the customer do not become
part of the contract unless expressly agreed.
A consumer is any natural person who concludes the contract for purposes which are
predominantly outside their trade, business or profession (§ 13 BGB).
§ 2 Subject matter
Only digital content is offered, in particular bobbin lace patterns and designs
supplied as file packages (ZIP archive containing PDF, GIF and/or JPEG files). No physical
goods are shipped. The specific description of each item appears on the relevant product
page.
§ 3 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding
offer but an invitation to order. By clicking the “Buy” or “Order with obligation to pay”
button you submit a binding offer. The contract is concluded when I accept your order by
separate confirmation e-mail or make the digital content available.
The contract text is stored and sent to you together with the terms by e-mail.
Contracts may be concluded in German, English or Czech; the German version of these terms
prevails.
§ 4 Prices
All prices are in euros and are final prices. Because the small business rule under
§ 19 UStG applies, no VAT is levied and none is therefore shown. No shipping costs arise,
as only digital content is supplied. Your payment service provider may charge you fees.
§ 5 Payment
Payment is made via the payment services offered during checkout (currently credit or
debit card, Klarna and Link, processed by Stripe). The digital content is made available
once payment has been completed successfully.
§ 6 Delivery of the digital content
Once payment has been received you will receive a personal download link by e-mail; if
you hold a customer account, the files are additionally available there. The download link
is valid indefinitely and may be used as often as you like. Please check your spam folder if
necessary. If the download does not work, a message to
fuseaux@web.de is enough and I will supply the files
again.
§ 7 Rights of use
Upon full payment you receive a simple, non-transferable right to use and reproduce the
purchased patterns for private purposes, to the extent necessary to make your own lace
work.
In particular, it is not permitted to pass on, resell, lend, publish or otherwise make
the files available to third parties – including in modified form, in course materials or
on social networks.
Lace work made from the purchased patterns may be made for private use only and may not be sold.
Copyright in the patterns remains with the provider in every case.
§ 8 Right of withdrawal
Consumers have a statutory right of withdrawal. For details, and for the conditions
under which that right expires early for digital content, please see the
withdrawal policy.
§ 9 Liability for defects
The statutory provisions on liability for defects apply, in particular §§ 327 et seq.
BGB for digital products. If the files supplied are faulty or incomplete, I will at your
choice provide a version free of defects or refund the purchase price.
§ 10 Liability
I am liable in accordance with the statutory provisions for damage arising from injury
to life, body or health and from breach of material contractual obligations. Otherwise I
am liable only for intent and gross negligence. In cases of simple negligence, liability
is limited to the foreseeable damage typical of the contract. Liability under the German
Product Liability Act remains unaffected.
§ 11 System requirements
To use the digital content you need a device capable of extracting ZIP archives and
displaying PDF and image files. You are responsible for providing suitable hardware and
software.
§ 12 Consumer dispute resolution
I am neither willing nor obliged to take part in dispute resolution proceedings before
a consumer arbitration board (§ 36 VSBG).
§ 13 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on
Contracts for the International Sale of Goods. For consumers this choice of law applies
only to the extent that it does not remove the protection afforded by mandatory provisions
of the law of the country in which the consumer is habitually resident. Should any
provision of these terms be invalid, the validity of the remaining provisions is
unaffected.
